Internetska kupnja nosi brojne rizike, a slučaj iz Dubrovnika pokazuje da se za svaki uplaćeni euro predujma vrijedi boriti.

Iskustvo bračnog para koji je još u listopadu prošle godine naručio proizvod vrijedan 37,16 eura sa stranice "Odaberi i naruči", u vlasništvu tvrtke registrirane u Osijeku, pokazuje da ne treba odustati bez obzira na iznos narudžbe.

Proizvod naručen 27. listopada nije dostavljen u zakonskom roku, pa čak ni nakon 75 dana, što je na stranici navedeni krajnji rok isporuke. Shvativši da naručene tekstilne navlake neće primiti, zatražili su povrat novca.

Naši sugovornici pokazuju niz poruka od veljače ove godine u kojima im je obećana refundacija u što kraćem roku. Reklamacija im je potvrđena u ožujku, ali povrat novca nikako nije stizao na njihov račun.

– Mislili smo da novac više nećemo vidjeti. Možda i nije neki iznos, ali na kraju smo odlučili prijaviti stranicu da drugi ne bi doživjeli isto – kaže Dubrovkinja.

Slučaj su najprije prijavili Hrvatskoj udruzi za zaštitu potrošača (HUZP). Na novinarsko pitanje, Ana Knežević, predsjednica HUZP-a, rekla je kako su imali više sličnih dojava o spomenutoj online trgovini te je savjetovala naručiteljima iz Dubrovnika i svima sa sličnim iskustvom da podnesu prijavu Državnom inspektoratu (DIRH).

Oštećeni klijenti trebaju navesti sve podatke o narudžbi, dostaviti račun, opisati komunikaciju i zatražiti inspekcijski nadzor. Savjet se pokazao vrijednim, a prijava inspekciji jednostavna, brza i učinkovita!

Nakon silnih natezanja, poziva, dopisivanja i neispunjenih obećanja, a nakon prijave DIRH-u, u roku od tjedan dana naručiteljima je vraćen iznos od 37,16 eura. I, očito, nisu bili jedini koji su se na takav način ponovno domogli svojeg novca.

– Tržišna inspekcija zaprimila je predstavke potrošača koje ukazuju na možebitne nepravilnosti vezano uz neispunjenje ugovora trgovca iz vašega upita te je provedenim inspekcijskim nadzorima u pet slučajeva utvrđeno da trgovac nije u zakonskom roku ispunio ugovor i potrošačima je vratio uplaćeni predujam.

Slijedom navedenoga tržišna inspekcija za utvrđene prekršaje podnijela je optužne prijedloge nadležnom prekršajnom sudu. Isto tako, u pet inspekcijskih nadzora utvrđeno je da je trgovac obavio povrat uplaćenog predujma, tri inspekcijska nadzora su u tijeku, dok je u devet slučajeva trgovac prije pokretanja inspekcijskog nadzora vratio potrošačima uplaćeni predujam – navode iz DIRH-a za spomenutu online trgovinu.

Slično iskustvo ima i Dubrovčanin koji je od druge tvrtke, registrirane u Zagrebu, naručio madrac vrijedan 563,40 eura. Nakon isteka svih ugovornih i razumnih rokova dostave, bezuspješno je pokušao vratiti uplaćeni iznos, trgovcu se obraćao pisanim putem i osobno, u njihovoj trgovini u Splitu, a novac mu je vraćen tek nakon prijave DIRH-u.

Zakon o zaštiti potrošača navodi da je trgovac dužan potrošaču ispuniti ugovor o kupoprodaji bez odgađanja, a najkasnije u roku od 30 dana od sklapanja ugovora. Inače, svatko se ima pravo obratiti Državnom inspektoratu, bez obzira vrijedi li proizvod samo jedan euro ili mnogo više.

Ako trgovac ne ispuni ugovor u roku, dužan je o tome pisano obavijestiti potrošača. Kupac ima pravo na raskid ugovora samo ako je dao trgovcu naknadni razumni rok za ispunjenje ugovora, osim ako iz okolnosti slučaja proizlazi da trgovac neće moći ugovor ispuniti ni u naknadnom roku.

Iz DIRH-a napominju da će tržišni inspektor uzeti u obzir predstavku potrošača tek nakon što je građanin iscrpio pravni put. Zato je uputno najprije podnijeti pisani prigovor trgovcu i pričekati 15 dana, koliki je rok za odgovor.

Nakon toga, naručitelj koji nije dobio plaćeni proizvod ili uslugu inspekciji mora poslati predstavku sa svim važnim informacijama. Uz svoje osobne podatke, ime, prezime i adresu, treba navesti podatke o trgovcu, navesti činjenice, dostaviti reklamaciju ili prepisku s trgovinom. Ako trgovac potrošaču nije ispunio ugovor u zakonskom, odnosno ugovorenom roku, najjednostavnije je prijavu poslati ispunjavanjem elektroničkog obrasca na službenoj stranici Državnog inspektorata.

Internetska kupnja nosi brojne rizike, a slučaj iz Dubrovnika pokazuje da se za svaki uplaćeni euro predujma vrijedi boriti.

Iskustvo bračnog para koji je još u listopadu prošle godine naručio proizvod vrijedan 37,16 eura sa stranice "Odaberi i naruči", u vlasništvu tvrtke registrirane u Osijeku, pokazuje da ne treba odustati bez obzira na iznos narudžbe.

Proizvod naručen 27. listopada nije dostavljen u zakonskom roku, pa čak ni nakon 75 dana, što je na stranici navedeni krajnji rok isporuke. Shvativši da naručene tekstilne navlake neće primiti, zatražili su povrat novca.

Naši sugovornici pokazuju niz poruka od veljače ove godine u kojima im je obećana refundacija u što kraćem roku. Reklamacija im je potvrđena u ožujku, ali povrat novca nikako nije stizao na njihov račun.

– Mislili smo da novac više nećemo vidjeti. Možda i nije neki iznos, ali na kraju smo odlučili prijaviti stranicu da drugi ne bi doživjeli isto – kaže Dubrovkinja.

Slučaj su najprije prijavili Hrvatskoj udruzi za zaštitu potrošača (HUZP). Na novinarsko pitanje, Ana Knežević, predsjednica HUZP-a, rekla je kako su imali više sličnih dojava o spomenutoj online trgovini te je savjetovala naručiteljima iz Dubrovnika i svima sa sličnim iskustvom da podnesu prijavu Državnom inspektoratu (DIRH).

Oštećeni klijenti trebaju navesti sve podatke o narudžbi, dostaviti račun, opisati komunikaciju i zatražiti inspekcijski nadzor. Savjet se pokazao vrijednim, a prijava inspekciji jednostavna, brza i učinkovita!

Nakon silnih natezanja, poziva, dopisivanja i neispunjenih obećanja, a nakon prijave DIRH-u, u roku od tjedan dana naručiteljima je vraćen iznos od 37,16 eura. I, očito, nisu bili jedini koji su se na takav način ponovno domogli svojeg novca.

– Tržišna inspekcija zaprimila je predstavke potrošača koje ukazuju na možebitne nepravilnosti vezano uz neispunjenje ugovora trgovca iz vašega upita te je provedenim inspekcijskim nadzorima u pet slučajeva utvrđeno da trgovac nije u zakonskom roku ispunio ugovor i potrošačima je vratio uplaćeni predujam.

Slijedom navedenoga tržišna inspekcija za utvrđene prekršaje podnijela je optužne prijedloge nadležnom prekršajnom sudu. Isto tako, u pet inspekcijskih nadzora utvrđeno je da je trgovac obavio povrat uplaćenog predujma, tri inspekcijska nadzora su u tijeku, dok je u devet slučajeva trgovac prije pokretanja inspekcijskog nadzora vratio potrošačima uplaćeni predujam – navode iz DIRH-a za spomenutu online trgovinu.

Slično iskustvo ima i Dubrovčanin koji je od druge tvrtke, registrirane u Zagrebu, naručio madrac vrijedan 563,40 eura. Nakon isteka svih ugovornih i razumnih rokova dostave, bezuspješno je pokušao vratiti uplaćeni iznos, trgovcu se obraćao pisanim putem i osobno, u njihovoj trgovini u Splitu, a novac mu je vraćen tek nakon prijave DIRH-u.

Zakon o zaštiti potrošača navodi da je trgovac dužan potrošaču ispuniti ugovor o kupoprodaji bez odgađanja, a najkasnije u roku od 30 dana od sklapanja ugovora. Inače, svatko se ima pravo obratiti Državnom inspektoratu, bez obzira vrijedi li proizvod samo jedan euro ili mnogo više.

Ako trgovac ne ispuni ugovor u roku, dužan je o tome pisano obavijestiti potrošača. Kupac ima pravo na raskid ugovora samo ako je dao trgovcu naknadni razumni rok za ispunjenje ugovora, osim ako iz okolnosti slučaja proizlazi da trgovac neće moći ugovor ispuniti ni u naknadnom roku.

Iz DIRH-a napominju da će tržišni inspektor uzeti u obzir predstavku potrošača tek nakon što je građanin iscrpio pravni put. Zato je uputno najprije podnijeti pisani prigovor trgovcu i pričekati 15 dana, koliki je rok za odgovor.

Nakon toga, naručitelj koji nije dobio plaćeni proizvod ili uslugu inspekciji mora poslati predstavku sa svim važnim informacijama. Uz svoje osobne podatke, ime, prezime i adresu, treba navesti podatke o trgovcu, navesti činjenice, dostaviti reklamaciju ili prepisku s trgovinom. Ako trgovac potrošaču nije ispunio ugovor u zakonskom, odnosno ugovorenom roku, najjednostavnije je prijavu poslati ispunjavanjem elektroničkog obrasca na službenoj stranici Državnog inspektorata.
