Zadarsko tužiteljstvo žalilo se na preblage kazne koje su u svibnju prošle godine na Općinskom sudu u Zadru izrečene trojci zbog prijetnje 32-godišnjoj ženi u visokom stupnju trudnoće.

Prvooptuženi Vlado Jozić angažirao je Alena Buknu i Roberta Žgelu u ožujku 2013. godine da od njegove bivše podstanarke uz prijetnje ‘naplate‘ pet tisuća eura na ime neplaćene stanarine. Ženu su najprije zastrašivali telefonom, a onda su joj banuli i u stan gdje su joj prijetili pred članovima obitelji.

Jozić je osuđen na deset mjeseci zatvora s uvjetom od jedne godine, Bukne na jednu godinu, s uvjetom od četiri godine, a Žgela je osuđen na deset mjeseci zatvora, s uvjetom od jedne godine.

Zamjenica Općinske državne odvjetnice u Zadru Maša Jurjević tražila je od Županijskog suda u Zadru da tu presudu preinači, te trojku osudi na strože kazne. Obrazložila je kako su im izrečene uvjetne zatvorske kazne jer su odlikovani sudionici Domovinskog rata što je sud uzeo kao olakotne okolnosti, iako su ženi ozbiljno prijetili, te ju pokušali silom prisiliti da što učini na štetu svoje imovine.

U tome su, kako je navela, pokazali iznimnu upornost i bešćutnost u postupanju što im je svakako trebalo biti ocjenjeno kao otegotno. Štoviše, drugookrivljeni Alen Bukna do sad je osuđen u dva navrata. Zbog nepružanje medicinske pomoći izrečena mu je uvjetna kazna zatvora, kao i presudom Općinskog suda u Vukovaru zbog napada na službenu osobu kada mu je izrečena bezuvjetna kazna zatvora od jedne godine. Protiv njega se trenutno vodi još jedan kazneni postupak pred Općinskim sudom u Vukovaru, što ukazuje na njegovu iznimnu upornost u činjenju kaznenih djela.

- Izrečene uvjetne kazne zatvora su preblage. Naime, Sud je odlučujući o vrsti i mjeri kazne koju je primijenio na okrivljenike precijenio utvrđene olakotne okolnosti kod I. okrivljenika u vidu njegove dosadašnje neosuđivanosti, činjenice da je otac četvero djece, da je sudionik Domovinskog rata sa činom pukovnika, višestruko odlikovan, a kod II. okrivljenika da je otac dvoje djece i sudionik Domovinskog rata sa činom narednika i odlikovan Spomenicom Domovinskog rata, kao i za III. okrivljenika da je neosuđivan, otac petero djece, sudionik Domovinskog rata sa činom narednika, višestruko odlikovan, a za sve okrivljenike olakotnu okolnost da je djelo ostalo u pokušaju te da je od počinjenja djela prošlo više od deset godina - navedeno je u žalbi na presudu kojom se, kako je istaknuto mora utjecati na svijest svih građana da ne čine kaznena djela.

- Izricanjem uvjetne kazne zatvora osobi koja uporno više od desetljeća čini kaznena djela i nastavlja s činjenjem kaznenih djela i nakon što mu je izrečena bezuvjetna kazna zatvora, neće poslati poruku društvu da se činjenje kaznenih djela ne tolerira, jer je Sud prilikom odlučivanja o vrsti i mjeri kazne koju će primijeniti na II. okrivljenika, ali i odnosu na I. i III. okrivljenika, propustio poslati jasnu i nedvosmislenu poruku o ozbiljnosti počinjenog kaznenog djela i nedvosmislenu poruku društvene osude takvog ponašanja, pa izrečena kazna neće utjecati niti na okrivljenike, a niti na sve druge da ne čine kaznena djela kroz jačanje svijesti o pogibeljnosti činjenja kaznenih djela i o pravednosti kažnjavanja počinitelja - navela je u žalbi državna odvjetnica Maša Jurjević.

Zadarsko tužiteljstvo žalilo se na preblage kazne koje su u svibnju prošle godine na Općinskom sudu u Zadru izrečene trojci zbog prijetnje 32-godišnjoj ženi u visokom stupnju trudnoće.

Prvooptuženi Vlado Jozić angažirao je Alena Buknu i Roberta Žgelu u ožujku 2013. godine da od njegove bivše podstanarke uz prijetnje ‘naplate‘ pet tisuća eura na ime neplaćene stanarine. Ženu su najprije zastrašivali telefonom, a onda su joj banuli i u stan gdje su joj prijetili pred članovima obitelji.

Jozić je osuđen na deset mjeseci zatvora s uvjetom od jedne godine, Bukne na jednu godinu, s uvjetom od četiri godine, a Žgela je osuđen na deset mjeseci zatvora, s uvjetom od jedne godine.

Zamjenica Općinske državne odvjetnice u Zadru Maša Jurjević tražila je od Županijskog suda u Zadru da tu presudu preinači, te trojku osudi na strože kazne. Obrazložila je kako su im izrečene uvjetne zatvorske kazne jer su odlikovani sudionici Domovinskog rata što je sud uzeo kao olakotne okolnosti, iako su ženi ozbiljno prijetili, te ju pokušali silom prisiliti da što učini na štetu svoje imovine.

U tome su, kako je navela, pokazali iznimnu upornost i bešćutnost u postupanju što im je svakako trebalo biti ocjenjeno kao otegotno. Štoviše, drugookrivljeni Alen Bukna do sad je osuđen u dva navrata. Zbog nepružanje medicinske pomoći izrečena mu je uvjetna kazna zatvora, kao i presudom Općinskog suda u Vukovaru zbog napada na službenu osobu kada mu je izrečena bezuvjetna kazna zatvora od jedne godine. Protiv njega se trenutno vodi još jedan kazneni postupak pred Općinskim sudom u Vukovaru, što ukazuje na njegovu iznimnu upornost u činjenju kaznenih djela.

- Izrečene uvjetne kazne zatvora su preblage. Naime, Sud je odlučujući o vrsti i mjeri kazne koju je primijenio na okrivljenike precijenio utvrđene olakotne okolnosti kod I. okrivljenika u vidu njegove dosadašnje neosuđivanosti, činjenice da je otac četvero djece, da je sudionik Domovinskog rata sa činom pukovnika, višestruko odlikovan, a kod II. okrivljenika da je otac dvoje djece i sudionik Domovinskog rata sa činom narednika i odlikovan Spomenicom Domovinskog rata, kao i za III. okrivljenika da je neosuđivan, otac petero djece, sudionik Domovinskog rata sa činom narednika, višestruko odlikovan, a za sve okrivljenike olakotnu okolnost da je djelo ostalo u pokušaju te da je od počinjenja djela prošlo više od deset godina - navedeno je u žalbi na presudu kojom se, kako je istaknuto mora utjecati na svijest svih građana da ne čine kaznena djela.

- Izricanjem uvjetne kazne zatvora osobi koja uporno više od desetljeća čini kaznena djela i nastavlja s činjenjem kaznenih djela i nakon što mu je izrečena bezuvjetna kazna zatvora, neće poslati poruku društvu da se činjenje kaznenih djela ne tolerira, jer je Sud prilikom odlučivanja o vrsti i mjeri kazne koju će primijeniti na II. okrivljenika, ali i odnosu na I. i III. okrivljenika, propustio poslati jasnu i nedvosmislenu poruku o ozbiljnosti počinjenog kaznenog djela i nedvosmislenu poruku društvene osude takvog ponašanja, pa izrečena kazna neće utjecati niti na okrivljenike, a niti na sve druge da ne čine kaznena djela kroz jačanje svijesti o pogibeljnosti činjenja kaznenih djela i o pravednosti kažnjavanja počinitelja - navela je u žalbi državna odvjetnica Maša Jurjević.

Prijetili 35-godišnjakinji u visokom stupnju trudnoće, a zadarski sud im izrekao uvjetne kazne jer su odlikovani sudionici Domovinskog rata!

Zadarsko tužiteljstvo žalilo se na preblage kazne koje su u svibnju prošle godine na Općinskom sudu u Zadru izrečene trojci zbog prijetnje 32-godišnjoj ženi u visokom stupnju trudnoće.

Prvooptuženi Vlado Jozić angažirao je Alena Buknu i Roberta Žgelu u ožujku 2013. godine da od njegove bivše podstanarke uz prijetnje ‘naplate‘ pet tisuća eura na ime neplaćene stanarine. Ženu su najprije zastrašivali telefonom, a onda su joj banuli i u stan gdje su joj prijetili pred članovima obitelji.

Jozić je osuđen na deset mjeseci zatvora s uvjetom od jedne godine, Bukne na jednu godinu, s uvjetom od četiri godine, a Žgela je osuđen na deset mjeseci zatvora, s uvjetom od jedne godine.

Zamjenica Općinske državne odvjetnice u Zadru Maša Jurjević tražila je od Županijskog suda u Zadru da tu presudu preinači, te trojku osudi na strože kazne. Obrazložila je kako su im izrečene uvjetne zatvorske kazne jer su odlikovani sudionici Domovinskog rata što je sud uzeo kao olakotne okolnosti, iako su ženi ozbiljno prijetili, te ju pokušali silom prisiliti da što učini na štetu svoje imovine.
