Općinski sud u Zadru odgodio je ovrhu zemljišta na Polačišću najavljenu za petak. Sutkinja Tereza Mitrović u četvrtak je prihvatila prijedlog predstavnika stanara zgrade u ulici Petra Svačića (od broja 3 do 11) za odgodom ovrhe odnosno uvođenja vlasnika tvrtke RamseyBay u posjed. 

Riječ je o dijelu nekretnine koju je Grad Zadar 2008. prodao tvrtki Centar projekt u vlasništvu Mladena Ninčevića za izgradnju hotela visoke kategorije. Njegovoj namjeri, međutim, ispriječili su se stanari susjedne zgrade koji dio kupljenog zemljišta godinama koriste za parking. Uslijedilo je dugogodišnje sudsko sporenje u kojem je stanarima priznato pravo posjeda, ali je Ninčević pravomoćno dobio tužbu za ometanje posjeda. Stanari su tražili reviziju te presude, no Vrhovni sud je prošle godine njihov zahtjev odbio.

- Sud je odgodio postupak uvođenja u posjed zato što još nije odlučio o našem zahtjevu za odgodom ovrhe – kaže Dan Marinović, odvjetnik koji zastupa Silvia Butića, Tomislava Pavičića i Nediljka Ikića, stanare iz Ulice Petra Svačića 3.

- Naime, mi smo se žalili na rješenje o ovrsi. Županijski sud je našu žalbu prihvatio i predmet vratio na ponovno odlučivanje jer smo u međuvremenu zatražili reviziju odluke rješenja o ovrsi. Međutim, sutkinja je pokrenula postupak ovrhe, prije nego što je ponovno odlučivala o našem prijedlogu u ponovljenom postupku. A o njemu će moći odlučiti tek kada bude riješen naš zahtijev za revizijom postupka - objašnjava odvjetnik stanara i najavljuje dugogodišnju pravnu bitku.

- Istovremeno smo podnijeli i dvije ustavne tužbe, jednu u ovršnom postupku, a drugu u parničnom postupku. Tražili smo i reviziju pravomoćne presude u parničnom postupku, ali nas je Vrhovni sud odbio. Ako nas odbije i Ustavni sud, ići ćemo na Sud za ljudska prava u Strasbourgu. Ako i tamo ne dobijemo, ići ćemo na Međunarodni sud pravde u Haagu, ako treba i na Međunarodni sud u Washingtonu. Iskoristi ćemo sve izvanredne pravne lijekove u našoj borbi da dokažemo da smo u pravu – odlučan je odvjetnik Marinović u namjeri da pravim putem blokira privatnu imovinu tvrtke RamseyBay sve dok se ne ispune obveze prema njegovim strankama iz kupoprodajnog ugovora.

On naime smatra da su stanari oštećeni u postupku prodaje gradskog zemljišta privatnom investitoru jer Centar projekt nije ispunio uvjete iz kupoprodajnog ugovora i stanarima osigurao 50 parkirnih mjesta na parceli ispred njihove stambene zgrade koju oni koriste od 60-ih godina prošlog stoljeća. Tu obvezu na sebe je sada preuzeo RamseyBay i Marinović očekuje da je ispuni. U protivnom bi Grad Zadar mogao odbiti izdati građevinsku dozvolu investitoru, odnosno mogao bi tražiti raskidanje kupoprodajnog ugovora.

Kao rješenje spora odvjetnik stanara predlaže da Grad Zadar otkupi 1120 kvadratnih metara od tvrtke RamseyBay i na njemu osigura javni parking. Na pitanje zašto bi Grad Zadar trebao otkupiti zemljište a ne stanari koji ga žele zbog parkinga, Marinović nam je rekao da i ta mogućnost postoji.

Podsjetimo da je banka 2017. zaplijenila zemljište Centar projekta te ga na dražbi prodala tvrtki RamseyBay u vlasništvu Denisa Mikana iz Australije za 20,7 milijuna kuna. Pravomoćna presuda za ometanje posjeda u korist Centar projekta, odnosno RamseyBaya, donesena je 2020., ali novi vlasnik još uvijek nije uveden u posjed.

Općinski sud u Zadru odgodio je ovrhu zemljišta na Polačišću najavljenu za petak. Sutkinja Tereza Mitrović u četvrtak je prihvatila prijedlog predstavnika stanara zgrade u ulici Petra Svačića (od broja 3 do 11) za odgodom ovrhe odnosno uvođenja vlasnika tvrtke RamseyBay u posjed. 

Riječ je o dijelu nekretnine koju je Grad Zadar 2008. prodao tvrtki Centar projekt u vlasništvu Mladena Ninčevića za izgradnju hotela visoke kategorije. Njegovoj namjeri, međutim, ispriječili su se stanari susjedne zgrade koji dio kupljenog zemljišta godinama koriste za parking. Uslijedilo je dugogodišnje sudsko sporenje u kojem je stanarima priznato pravo posjeda, ali je Ninčević pravomoćno dobio tužbu za ometanje posjeda. Stanari su tražili reviziju te presude, no Vrhovni sud je prošle godine njihov zahtjev odbio.

- Sud je odgodio postupak uvođenja u posjed zato što još nije odlučio o našem zahtjevu za odgodom ovrhe – kaže Dan Marinović, odvjetnik koji zastupa Silvia Butića, Tomislava Pavičića i Nediljka Ikića, stanare iz Ulice Petra Svačića 3.

- Naime, mi smo se žalili na rješenje o ovrsi. Županijski sud je našu žalbu prihvatio i predmet vratio na ponovno odlučivanje jer smo u međuvremenu zatražili reviziju odluke rješenja o ovrsi. Međutim, sutkinja je pokrenula postupak ovrhe, prije nego što je ponovno odlučivala o našem prijedlogu u ponovljenom postupku. A o njemu će moći odlučiti tek kada bude riješen naš zahtijev za revizijom postupka - objašnjava odvjetnik stanara i najavljuje dugogodišnju pravnu bitku.

- Istovremeno smo podnijeli i dvije ustavne tužbe, jednu u ovršnom postupku, a drugu u parničnom postupku. Tražili smo i reviziju pravomoćne presude u parničnom postupku, ali nas je Vrhovni sud odbio. Ako nas odbije i Ustavni sud, ići ćemo na Sud za ljudska prava u Strasbourgu. Ako i tamo ne dobijemo, ići ćemo na Međunarodni sud pravde u Haagu, ako treba i na Međunarodni sud u Washingtonu. Iskoristi ćemo sve izvanredne pravne lijekove u našoj borbi da dokažemo da smo u pravu – odlučan je odvjetnik Marinović u namjeri da pravim putem blokira privatnu imovinu tvrtke RamseyBay sve dok se ne ispune obveze prema njegovim strankama iz kupoprodajnog ugovora.

On naime smatra da su stanari oštećeni u postupku prodaje gradskog zemljišta privatnom investitoru jer Centar projekt nije ispunio uvjete iz kupoprodajnog ugovora i stanarima osigurao 50 parkirnih mjesta na parceli ispred njihove stambene zgrade koju oni koriste od 60-ih godina prošlog stoljeća. Tu obvezu na sebe je sada preuzeo RamseyBay i Marinović očekuje da je ispuni. U protivnom bi Grad Zadar mogao odbiti izdati građevinsku dozvolu investitoru, odnosno mogao bi tražiti raskidanje kupoprodajnog ugovora.

Kao rješenje spora odvjetnik stanara predlaže da Grad Zadar otkupi 1120 kvadratnih metara od tvrtke RamseyBay i na njemu osigura javni parking. Na pitanje zašto bi Grad Zadar trebao otkupiti zemljište a ne stanari koji ga žele zbog parkinga, Marinović nam je rekao da i ta mogućnost postoji.

Podsjetimo da je banka 2017. zaplijenila zemljište Centar projekta te ga na dražbi prodala tvrtki RamseyBay u vlasništvu Denisa Mikana iz Australije za 20,7 milijuna kuna. Pravomoćna presuda za ometanje posjeda u korist Centar projekta, odnosno RamseyBaya, donesena je 2020., ali novi vlasnik još uvijek nije uveden u posjed.

Općinski sud u Zadru odgodio je ovrhu zemljišta na Polačišću najavljenu za petak. Sutkinja Tereza Mitrović u četvrtak je prihvatila prijedlog predstavnika stanara zgrade u ulici Petra Svačića (od broja 3 do 11) za odgodom ovrhe odnosno uvođenja vlasnika tvrtke RamseyBay u posjed. 

Riječ je o dijelu nekretnine koju je Grad Zadar 2008. prodao tvrtki Centar projekt u vlasništvu Mladena Ninčevića za izgradnju hotela visoke kategorije. Njegovoj namjeri, međutim, ispriječili su se stanari susjedne zgrade koji dio kupljenog zemljišta godinama koriste za parking. Uslijedilo je dugogodišnje sudsko sporenje u kojem je stanarima priznato pravo posjeda, ali je Ninčević pravomoćno dobio tužbu za ometanje posjeda. Stanari su tražili reviziju te presude, no Vrhovni sud je prošle godine njihov zahtjev odbio.
