Vozač iz Tirane, 44-godišnji B.B., koji se prije dvije godine zbog nepažnje prevrnuo na autocesti A1 kod odmorišta Jasenice, na zadarskom području zbog čega je 23-oje putnika lakše, a dvoje teže ozlijeđeno, pravomoćno je osuđen na uvjetnu zatvorsku kaznu na Općinskom sudu u Zadru.

U kaznenom nalogu izrečena mu je uvjetna zatvorska kazna od osam mjeseci zatvora s rokom kušnje od tri godine. Utvrđeno je da je iz nehaja, kao sudionik u cestovnom prometu krśenjem propisa o sigurnosti prometa izazvao opasnost za život ili tijelo Ijudi, pa je zbog toga prouzročio teške tjelesne ozljede dviju osoba.

Dužan je i platiti unaprijed plaćene troškove postupka u iznosu od sedamsto kuna u korist računa Državnog proračuna Republike Hrvatske.

Nesreća se dogodila 28. listopada 2020. u 11 sati, u mjestu Jasenice, na autocesti A1, kada je 44-godišnji vozač, državljanin Albanije, upravljajući autobusom marke "Setra", albanskih nacionalnih oznaka, protivno odredbi članka 46. stavka 1. Zakona o sigurnosti prometa na cestama, prešao na desnu stranu kolnika, odnosno prema južnom rubu kolnika. To je učinio iako je bio svjestan da za vožnju autobusa mora koristiti sredinu obilježene prometne trake namjenjene za njegov smjer kretanja, lakomisleno drżećí da neće nastupiti štetne posljedice za druge sudionike u prometu.

Zbog toga je izletio sa kolnika u smjeru jugoistoka na meki teren s južne strane kolnika, gdje je sa prednjim desnim, a potom sa cijelim desnim bočnim dijelom autobusa, udario u kameni usjek, nakon čega se autobus vratio na kolnik, te se zaustavio na zaustavnoj prometnoj traci. Tom prilikom su teške tjelesne ozljede zadobili putnici B. K. u vidu višestrukog prijeloma gornjeg dijela lakatne kosti, a A. S. višestruki prijelom donjeg dijela lijeve nadlaktične kosti i oguljotinu lijevog ramena.

- Sud smatra da će izrečena sankcija utjecati na okrivljenika da ubuduće ne čini ovakva ili slična djela, odnosno da će se upravo izricanjem uvjetne osude postići svrha kažnjavanja.

Sud ga je ujedno obvezao na naknadu troška provedenog postupka koji je s obzirom na trajanje kao i složenost paušalno od strane suda procijenjen na iznos od 700,00 kuna s tim da sud vjeruje da će okrivljenik ovaj trošak moći podmiriti, a da pritom ne dovede u pitanje svoju vlastitu egzistenciju ili egzistenciju osoba koje je eventualno dužan uzdržavati-navodi se u obrazloženju presude.

Vozač iz Tirane, 44-godišnji B.B., koji se prije dvije godine zbog nepažnje prevrnuo na autocesti A1 kod odmorišta Jasenice, na zadarskom području zbog čega je 23-oje putnika lakše, a dvoje teže ozlijeđeno, pravomoćno je osuđen na uvjetnu zatvorsku kaznu na Općinskom sudu u Zadru.

U kaznenom nalogu izrečena mu je uvjetna zatvorska kazna od osam mjeseci zatvora s rokom kušnje od tri godine. Utvrđeno je da je iz nehaja, kao sudionik u cestovnom prometu krśenjem propisa o sigurnosti prometa izazvao opasnost za život ili tijelo Ijudi, pa je zbog toga prouzročio teške tjelesne ozljede dviju osoba.

Dužan je i platiti unaprijed plaćene troškove postupka u iznosu od sedamsto kuna u korist računa Državnog proračuna Republike Hrvatske.

Nesreća se dogodila 28. listopada 2020. u 11 sati, u mjestu Jasenice, na autocesti A1, kada je 44-godišnji vozač, državljanin Albanije, upravljajući autobusom marke "Setra", albanskih nacionalnih oznaka, protivno odredbi članka 46. stavka 1. Zakona o sigurnosti prometa na cestama, prešao na desnu stranu kolnika, odnosno prema južnom rubu kolnika. To je učinio iako je bio svjestan da za vožnju autobusa mora koristiti sredinu obilježene prometne trake namjenjene za njegov smjer kretanja, lakomisleno drżećí da neće nastupiti štetne posljedice za druge sudionike u prometu.

Zbog toga je izletio sa kolnika u smjeru jugoistoka na meki teren s južne strane kolnika, gdje je sa prednjim desnim, a potom sa cijelim desnim bočnim dijelom autobusa, udario u kameni usjek, nakon čega se autobus vratio na kolnik, te se zaustavio na zaustavnoj prometnoj traci. Tom prilikom su teške tjelesne ozljede zadobili putnici B. K. u vidu višestrukog prijeloma gornjeg dijela lakatne kosti, a A. S. višestruki prijelom donjeg dijela lijeve nadlaktične kosti i oguljotinu lijevog ramena.

- Sud smatra da će izrečena sankcija utjecati na okrivljenika da ubuduće ne čini ovakva ili slična djela, odnosno da će se upravo izricanjem uvjetne osude postići svrha kažnjavanja.

Sud ga je ujedno obvezao na naknadu troška provedenog postupka koji je s obzirom na trajanje kao i složenost paušalno od strane suda procijenjen na iznos od 700,00 kuna s tim da sud vjeruje da će okrivljenik ovaj trošak moći podmiriti, a da pritom ne dovede u pitanje svoju vlastitu egzistenciju ili egzistenciju osoba koje je eventualno dužan uzdržavati-navodi se u obrazloženju presude.

Vozač iz Tirane, 44-godišnji B.B., koji se prije dvije godine zbog nepažnje prevrnuo na autocesti A1 kod odmorišta Jasenice, na zadarskom području zbog čega je 23-oje putnika lakše, a dvoje teže ozlijeđeno, pravomoćno je osuđen na uvjetnu zatvorsku kaznu na Općinskom sudu u Zadru.

U kaznenom nalogu izrečena mu je uvjetna zatvorska kazna od osam mjeseci zatvora s rokom kušnje od tri godine. Utvrđeno je da je iz nehaja, kao sudionik u cestovnom prometu krśenjem propisa o sigurnosti prometa izazvao opasnost za život ili tijelo Ijudi, pa je zbog toga prouzročio teške tjelesne ozljede dviju osoba.

Dužan je i platiti unaprijed plaćene troškove postupka u iznosu od sedamsto kuna u korist računa Državnog proračuna Republike Hrvatske.

Nesreća se dogodila 28. listopada 2020. u 11 sati, u mjestu Jasenice, na autocesti A1, kada je 44-godišnji vozač, državljanin Albanije, upravljajući autobusom marke "Setra", albanskih nacionalnih oznaka, protivno odredbi članka 46. stavka 1. Zakona o sigurnosti prometa na cestama, prešao na desnu stranu kolnika, odnosno prema južnom rubu kolnika. To je učinio iako je bio svjestan da za vožnju autobusa mora koristiti sredinu obilježene prometne trake namjenjene za njegov smjer kretanja, lakomisleno drżećí da neće nastupiti štetne posljedice za druge sudionike u prometu.

Zbog toga je izletio sa kolnika u smjeru jugoistoka na meki teren s južne strane kolnika, gdje je sa prednjim desnim, a potom sa cijelim desnim bočnim dijelom autobusa, udario u kameni usjek, nakon čega se autobus vratio na kolnik, te se zaustavio na zaustavnoj prometnoj traci. Tom prilikom su teške tjelesne ozljede zadobili putnici B. K. u vidu višestrukog prijeloma gornjeg dijela lakatne kosti, a A. S. višestruki prijelom donjeg dijela lijeve nadlaktične kosti i oguljotinu lijevog ramena.

- Sud smatra da će izrečena sankcija utjecati na okrivljenika da ubuduće ne čini ovakva ili slična djela, odnosno da će se upravo izricanjem uvjetne osude postići svrha kažnjavanja.

Sud ga je ujedno obvezao na naknadu troška provedenog postupka koji je s obzirom na trajanje kao i složenost paušalno od strane suda procijenjen na iznos od 700,00 kuna s tim da sud vjeruje da će okrivljenik ovaj trošak moći podmiriti, a da pritom ne dovede u pitanje svoju vlastitu egzistenciju ili egzistenciju osoba koje je eventualno dužan uzdržavati-navodi se u obrazloženju presude.
