Nakon što je Ustavni sud utvrdio ozbiljne propuste u postupanjima Općinskog suda u Rijeci u procesu koji se vodi oko prava bivših supružnika na viđanje djeteta, nastavile su se redati bizarne sudske odluke vezane uz isti slučaj. Ovršni sudac koji ga vodi odlučio je, naime, novčane kazne majci zbog neprovođenja susreta djeteta s ocem pretvoriti u zatvorsku kaznu. Majka bi u zatvoru, prema rješenju riječkog suda, trebala provesti punih 80 dana.
Nevjerojatno je, pritom, da je sudac takvo rješenje donio dva tjedna nakon odluke Ustavnog suda o privremenoj obustavi ovrhe koja se odnosi na viđanje djeteta s ocem, i zbog koje je majci u konačnici i dosuđena novčana kazna.
Strah od oca
Ustavni je sud 5. ožujka odlučio obustaviti ovrhu do okončanja postupka, ocjenjujući da postoji opasnost da bi njenim izvršenjem mogle nastati teške i nepopravljive posljedice. Općinskom sudu u Rijeci ustavni su suci naložili da djetetu osigura posebnog skrbnika radi zaštite njegovih prava i interesa jer je to riječki sud, protivno Obiteljskom zakonu i Konvenciji u pravima djeteta, propustio učiniti. Dijete, naime, nije imalo priliku izjasniti se želi li viđati oca, i koliko, a sud nije uzeo u obzir ni ranije iskaze djeteta da je u strahu od oca, piše Novi list.

Majci djeteta riječki je sud u nekoliko navrata dosudio novčanu kaznu zbog onemogućavanja susreta djeteta s ocem, u ukupnom iznosu od 3.052,61 euro, a kako je ona čitavo vrijeme osporavala zakonitost takve ovrhe, kazne je odbijala platiti. Sada joj je Općinski sud izdao rješenje o zamjeni novčanih kazni za izdržavanje zatvorske kazne.
Inače, majka je prije mjesec dana ostala bez posla zbog kaznene prijave koju je otac djeteta podigao na temelju sudskog rješenja o ovrsi.
Nepoštovanje termina
Odvjetnica koja zastupa majku u ovom predmetu tvrdi da je najnovije rješenje Općinskog suda u Rijeci potpuno nezakonito, a o njemu je obavijestila sve nadležne instance, uključujući i Ustavni sud.
Majka upozorava i na niz drugih nepravilnosti: tvrdi da su joj novčane kazne izrečene potpuno neopravdano, za termine susreta koji nisu bili određeni rješenjem suda, već ih je otac sam odabrao.
– U najvećem sam dijelu terećena za dane koji nisu određeni za viđanje. Otac bi se naprosto pojavio u drugom terminu i javio sucu da majka nije dala dijete, a sudac bi me kaznio, ispričala je majka (podaci poznati redakciji Novog lista).

Nakon što je Ustavni sud utvrdio ozbiljne propuste u postupanjima Općinskog suda u Rijeci u procesu koji se vodi oko prava bivših supružnika na viđanje djeteta, nastavile su se redati bizarne sudske odluke vezane uz isti slučaj. Ovršni sudac koji ga vodi odlučio je, naime, novčane kazne majci zbog neprovođenja susreta djeteta s ocem pretvoriti u zatvorsku kaznu. Majka bi u zatvoru, prema rješenju riječkog suda, trebala provesti punih 80 dana.
Nevjerojatno je, pritom, da je sudac takvo rješenje donio dva tjedna nakon odluke Ustavnog suda o privremenoj obustavi ovrhe koja se odnosi na viđanje djeteta s ocem, i zbog koje je majci u konačnici i dosuđena novčana kazna.
Strah od oca
Ustavni je sud 5. ožujka odlučio obustaviti ovrhu do okončanja postupka, ocjenjujući da postoji opasnost da bi njenim izvršenjem mogle nastati teške i nepopravljive posljedice. Općinskom sudu u Rijeci ustavni su suci naložili da djetetu osigura posebnog skrbnika radi zaštite njegovih prava i interesa jer je to riječki sud, protivno Obiteljskom zakonu i Konvenciji u pravima djeteta, propustio učiniti. Dijete, naime, nije imalo priliku izjasniti se želi li viđati oca, i koliko, a sud nije uzeo u obzir ni ranije iskaze djeteta da je u strahu od oca, piše Novi list.

Majci djeteta riječki je sud u nekoliko navrata dosudio novčanu kaznu zbog onemogućavanja susreta djeteta s ocem, u ukupnom iznosu od 3.052,61 euro, a kako je ona čitavo vrijeme osporavala zakonitost takve ovrhe, kazne je odbijala platiti. Sada joj je Općinski sud izdao rješenje o zamjeni novčanih kazni za izdržavanje zatvorske kazne.
Inače, majka je prije mjesec dana ostala bez posla zbog kaznene prijave koju je otac djeteta podigao na temelju sudskog rješenja o ovrsi.
Nepoštovanje termina
Odvjetnica koja zastupa majku u ovom predmetu tvrdi da je najnovije rješenje Općinskog suda u Rijeci potpuno nezakonito, a o njemu je obavijestila sve nadležne instance, uključujući i Ustavni sud.
Majka upozorava i na niz drugih nepravilnosti: tvrdi da su joj novčane kazne izrečene potpuno neopravdano, za termine susreta koji nisu bili određeni rješenjem suda, već ih je otac sam odabrao.
– U najvećem sam dijelu terećena za dane koji nisu određeni za viđanje. Otac bi se naprosto pojavio u drugom terminu i javio sucu da majka nije dala dijete, a sudac bi me kaznio, ispričala je majka (podaci poznati redakciji Novog lista).
