Zbog pogreške liječnika Opća bolnica obitelji preminulog traktorista mora platiti čak milijun kuna odštete. Postane li presuda pravomoćna, taj će se iznos s kamatama popeti na više od 1,5 milijuna kuna.

Odlučio je tako sud uoči Božića. Presuda je nepravomoćna i Opća bolnica u Zaboku može se na nju žaliti, što će i učiniti. Prema presudi, traktorist Dragutin (70) u lipnju 2012. nešto prije 19 sati teško je stradao u izlijetanju traktora s ceste kod Pregrade. U bolnici su naveli kako je vozio pod utjecajem alkohola od čak 2,5 promila, piše Danica.hr. 

U zabočkoj bolnici obavljena je dijagnostika i krenulo se s liječenjem, ali nakon što mu se stanje pogoršalo treći je dan hitno prebačen u Kliniku za traumatologiju KBC-a Sestara milosrdnica u Zagrebu. Tamo ostaje sve do svibnja 2013. godine. Potom je s dijagnozom tetraplegije i teškim stanjem prebačen u Klenovnik gdje u listopadu 2013. umire od posljedica nesreće.

Na osnovi nalaza i mišljenja sudsko-medicinskih vještaka, sud je zaključio kako je bolnica zbog nesavjesnog liječenja kriva za Dragutinovu smrt te je osmeročlanoj obitelji – djeci i unucima – dosudio ukupno milijun kuna odštete. U međuvremenu je umrla i Dragutinova supruga.

Stalni sudski vještak radiolog dr. Srđan Gustinčić u svom nalazu i mišljenju je naveo kako “tijekom inicijalne RTG obrade u bolnici u Zaboku nisu uočene jasno vidljive frakture spinalnih nastavaka na C5 i C6 vratnim kralješcima i uz to nisu uočeni znakovi koji ukazuju na moguće frakture poprečnih nastavaka na C7 i trupa C7”.

Stalni sudski vještak neurokirurg dr. Boris Božić tvrdi kako je učinjen previd jer “nisu prepoznati prijelomi petog i šestog vratnog kralješka te također nije prepoznata subluksacija anterioni pomak trupa C5 prema C6 kralješku,što je za posljedicu imalo kompresiju leđne moždine koja se nalazi u spinalnom kanalu i oduzetost gornjih i donjih ekstremiteta”.

“Shodno istom, dolazi do razvoja kliničke slike tetraplegije i može se reći da previd gore opisanih prijeloma vratne kralježnice, zakašnjela daljna dijagonstika vratne kralježnice i cervikotorakalnog prijelaza predstavljaju ozbiljne stručne pogreške (….)

Indicirana kiruška intervencija na vratnoj kralježnici trebala je biti učinjena znatno ranije jer bi time period kompresije leđne moždine bio znatno kraći pa je teško oštećenje kralježnične moždine dovelo posljedično tome i do lezije, oštećenja drugih organskih sustava, što je rezultirao smrtnim ishodom”, ističe dr. Božić.

Sudac je na koncu zaključio kako su glavne pogreške u liječenju Dragutina bili “neprepoznati prijelomi donjeg dijela vratne i gornjeg dijela leđne kralježnice, što je za posljedicu imalo kompresiju tog dijela leđne moždine i

progresiju neurološkog ispada te je došlo do trajnog oštećenja leđne moždine”.

“Kao što to i objašnjava stalni sudski vještak neurokirurg dr. Boris Božić, u slučaju više od 6 sati pritiska na leđnu moždinu, dolazi do trajnih oštećenja leđne moždine ili spleta sprovodnih puteva iz mozga u ostale dijelove tijela čovjeka jer i minimalna oštećenja leđne moždine rezultiraju velikim neurološkim trajnim oštećenjima”, zaključio je sudac.

Bolnica se, uz ostalo, branila kako je Dragutin prilikom prijema bio prilično alkoholiziran što je otežavalo neurološku obradu, ali sudac taj argument nije uzeo u obzir, niti su mu medicinski vještaci pridavali pozornost.

Zbog pogreške liječnika Opća bolnica obitelji preminulog traktorista mora platiti čak milijun kuna odštete. Postane li presuda pravomoćna, taj će se iznos s kamatama popeti na više od 1,5 milijuna kuna.

Odlučio je tako sud uoči Božića. Presuda je nepravomoćna i Opća bolnica u Zaboku može se na nju žaliti, što će i učiniti. Prema presudi, traktorist Dragutin (70) u lipnju 2012. nešto prije 19 sati teško je stradao u izlijetanju traktora s ceste kod Pregrade. U bolnici su naveli kako je vozio pod utjecajem alkohola od čak 2,5 promila, piše Danica.hr. 

U zabočkoj bolnici obavljena je dijagnostika i krenulo se s liječenjem, ali nakon što mu se stanje pogoršalo treći je dan hitno prebačen u Kliniku za traumatologiju KBC-a Sestara milosrdnica u Zagrebu. Tamo ostaje sve do svibnja 2013. godine. Potom je s dijagnozom tetraplegije i teškim stanjem prebačen u Klenovnik gdje u listopadu 2013. umire od posljedica nesreće.

Na osnovi nalaza i mišljenja sudsko-medicinskih vještaka, sud je zaključio kako je bolnica zbog nesavjesnog liječenja kriva za Dragutinovu smrt te je osmeročlanoj obitelji – djeci i unucima – dosudio ukupno milijun kuna odštete. U međuvremenu je umrla i Dragutinova supruga.

Stalni sudski vještak radiolog dr. Srđan Gustinčić u svom nalazu i mišljenju je naveo kako “tijekom inicijalne RTG obrade u bolnici u Zaboku nisu uočene jasno vidljive frakture spinalnih nastavaka na C5 i C6 vratnim kralješcima i uz to nisu uočeni znakovi koji ukazuju na moguće frakture poprečnih nastavaka na C7 i trupa C7”.

Kiruška intervencija na vratnoj kralježnici trebala je biti učinjena znatno ranije jer bi time period kompresije leđne moždine bio znatno kraći – tvrdi dr. Boris Božić

Stalni sudski vještak neurokirurg dr. Boris Božić tvrdi kako je učinjen previd jer “nisu prepoznati prijelomi petog i šestog vratnog kralješka te također nije prepoznata subluksacija anterioni pomak trupa C5 prema C6 kralješku,što je za posljedicu imalo kompresiju leđne moždine koja se nalazi u spinalnom kanalu i oduzetost gornjih i donjih ekstremiteta”.

“Shodno istom, dolazi do razvoja kliničke slike tetraplegije i može se reći da previd gore opisanih prijeloma vratne kralježnice, zakašnjela daljna dijagonstika vratne kralježnice i cervikotorakalnog prijelaza predstavljaju ozbiljne stručne pogreške (….)

Indicirana kiruška intervencija na vratnoj kralježnici trebala je biti učinjena znatno ranije jer bi time period kompresije leđne moždine bio znatno kraći pa je teško oštećenje kralježnične moždine dovelo posljedično tome i do lezije, oštećenja drugih organskih sustava, što je rezultirao smrtnim ishodom”, ističe dr. Božić.

Sudac je na koncu zaključio kako su glavne pogreške u liječenju Dragutina bili “neprepoznati prijelomi donjeg dijela vratne i gornjeg dijela leđne kralježnice, što je za posljedicu imalo kompresiju tog dijela leđne moždine i

progresiju neurološkog ispada te je došlo do trajnog oštećenja leđne moždine”.

“Kao što to i objašnjava stalni sudski vještak neurokirurg dr. Boris Božić, u slučaju više od 6 sati pritiska na leđnu moždinu, dolazi do trajnih oštećenja leđne moždine ili spleta sprovodnih puteva iz mozga u ostale dijelove tijela čovjeka jer i minimalna oštećenja leđne moždine rezultiraju velikim neurološkim trajnim oštećenjima”, zaključio je sudac.

Bolnica se, uz ostalo, branila kako je Dragutin prilikom prijema bio prilično alkoholiziran što je otežavalo neurološku obradu, ali sudac taj argument nije uzeo u obzir, niti su mu medicinski vještaci pridavali pozornost.

Traktorist nakon prometne umro jer medicinsko osoblje nije vidjelo fatalne i evidentne prijelome kičme! Evo koliko je novca sud dosudio obitelji

Zbog pogreške liječnika Opća bolnica obitelji preminulog traktorista mora platiti čak milijun kuna odštete. Postane li presuda pravomoćna, taj će se iznos s kamatama popeti na više od 1,5 milijuna kuna.

Odlučio je tako sud uoči Božića. Presuda je nepravomoćna i Opća bolnica u Zaboku može se na nju žaliti, što će i učiniti. Prema presudi, traktorist Dragutin (70) u lipnju 2012. nešto prije 19 sati teško je stradao u izlijetanju traktora s ceste kod Pregrade. U bolnici su naveli kako je vozio pod utjecajem alkohola od čak 2,5 promila, piše Danica.hr. 

U zabočkoj bolnici obavljena je dijagnostika i krenulo se s liječenjem, ali nakon što mu se stanje pogoršalo treći je dan hitno prebačen u Kliniku za traumatologiju KBC-a Sestara milosrdnica u Zagrebu. Tamo ostaje sve do svibnja 2013. godine. Potom je s dijagnozom tetraplegije i teškim stanjem prebačen u Klenovnik gdje u listopadu 2013. umire od posljedica nesreće.

Na osnovi nalaza i mišljenja sudsko-medicinskih vještaka, sud je zaključio kako je bolnica zbog nesavjesnog liječenja kriva za Dragutinovu smrt te je osmeročlanoj obitelji – djeci i unucima – dosudio ukupno milijun kuna odštete. U međuvremenu je umrla i Dragutinova supruga.

Stalni sudski vještak radiolog dr. Srđan Gustinčić u svom nalazu i mišljenju je naveo kako “tijekom inicijalne RTG obrade u bolnici u Zaboku nisu uočene jasno vidljive frakture spinalnih nastavaka na C5 i C6 vratnim kralješcima i uz to nisu uočeni znakovi koji ukazuju na moguće frakture poprečnih nastavaka na C7 i trupa C7”.

Stalni sudski vještak neurokirurg dr. Boris Božić tvrdi kako je učinjen previd jer “nisu prepoznati prijelomi petog i šestog vratnog kralješka te također nije prepoznata subluksacija anterioni pomak trupa C5 prema C6 kralješku,što je za posljedicu imalo kompresiju leđne moždine koja se nalazi u spinalnom kanalu i oduzetost gornjih i donjih ekstremiteta”.
