Pronaći parkirno mjesto u mnogim splitskim kvartovima nije nimalo lak zadatak. U nedostatku izbora, ljudi su ponekad primorani nepropisno parkirati, a onda se često dogodi da ih na vozilu dočeka kazna ili, još gore, da vozilo ne pronađu tamo gdje su ga ostavili. Baš nedavno pauk služba “počistila” je vozila parkirana duž Dubrovačke ulice.
Iako je na nogostupu parkiranje i zaustavljanje generalno zabranjeno jer je on prvenstveno namijenjen pješacima, zakon kaže da se vozila na njemu mogu zaustaviti parkirati ako pješacima ostave 1,6 metara prolaza, a pod istim uvjetima mogu se i parkirati, uz znak dozvole parkiranja.
No, što određuje hoće li vas na vozilu dočekati kazna ili će vam pak pauk služba odvesti vozilo? Pauk služba ima pravo ukloniti vozilo s nogostupa u slučajevima kada pješaci zbog parkiranog vozila ne mogu proći nogostupom, odnosno vozač je ostavio manje od metra između svog vozila i zgrade ili zida.
Smije li onda pauk služba dizati vozila koja su na nogostupu nepropisno parkirana, a ostavljeno je dovoljno mjesta za pješake? Kako pišu iz HAK-a, zakon jasno kaže da ne smije, ali postoje neki problemi kod njegove primjene. Naveli su primjer sudskog postupka koji se vodio baš oko ovog problema, a u nastavku možete pročitati stajalište suda.
- Prema odredbi članka 82. stavak 1. točka 10. Zakona o sigurnosti prometa na cestama, je parkiranje dopušteno na nogostupu ako je za kretanje pješaka ostavljeno najmanje 1,6 m širine na površini za kretanje pješaka, s tim da ta površina ne može biti uz rub kolnika, a za takav prekršaj je predviđena novčana kazna, a ne i premještanje vozila po nalogu komunalnih redara, a da policijski službenik ili službenik jedinice lokalne samouprave prema članku 84. ZOSPC-a može naredbom odrediti premještanje vozila samo ako zbog zaustavljenog vozila pješak mora silaziti na kolnik ili drugu površinu odnosno da je prolaz između parkiranog vozila i zgrade manji od 100 centimetara – naveli su.
Dakle, ako nepropisno parkirate na nogostupu vjerojatno će vas na vozilu dočekati kazna, ali ako ostavite dovoljno mjesta za prolazak pješaka (više od jednog metra) pauk služba vam nema pravo ukloniti vozilo te moraju dokazati da je vaše vozilo ometalo kretanje pješaka. Preporučamo da ubuduće u obaveznu opremu dodate i jedan metar koji bi vas mogao spasiti od paprene kazne i odlaska po vozilo na Pujanke.

Pronaći parkirno mjesto u mnogim splitskim kvartovima nije nimalo lak zadatak. U nedostatku izbora, ljudi su ponekad primorani nepropisno parkirati, a onda se često dogodi da ih na vozilu dočeka kazna ili, još gore, da vozilo ne pronađu tamo gdje su ga ostavili. Baš nedavno pauk služba “počistila” je vozila parkirana duž Dubrovačke ulice.
Iako je na nogostupu parkiranje i zaustavljanje generalno zabranjeno jer je on prvenstveno namijenjen pješacima, zakon kaže da se vozila na njemu mogu zaustaviti parkirati ako pješacima ostave 1,6 metara prolaza, a pod istim uvjetima mogu se i parkirati, uz znak dozvole parkiranja.
No, što određuje hoće li vas na vozilu dočekati kazna ili će vam pak pauk služba odvesti vozilo? Pauk služba ima pravo ukloniti vozilo s nogostupa u slučajevima kada pješaci zbog parkiranog vozila ne mogu proći nogostupom, odnosno vozač je ostavio manje od metra između svog vozila i zgrade ili zida.
Smije li onda pauk služba dizati vozila koja su na nogostupu nepropisno parkirana, a ostavljeno je dovoljno mjesta za pješake? Kako pišu iz HAK-a, zakon jasno kaže da ne smije, ali postoje neki problemi kod njegove primjene. Naveli su primjer sudskog postupka koji se vodio baš oko ovog problema, a u nastavku možete pročitati stajalište suda.
- Prema odredbi članka 82. stavak 1. točka 10. Zakona o sigurnosti prometa na cestama, je parkiranje dopušteno na nogostupu ako je za kretanje pješaka ostavljeno najmanje 1,6 m širine na površini za kretanje pješaka, s tim da ta površina ne može biti uz rub kolnika, a za takav prekršaj je predviđena novčana kazna, a ne i premještanje vozila po nalogu komunalnih redara, a da policijski službenik ili službenik jedinice lokalne samouprave prema članku 84. ZOSPC-a može naredbom odrediti premještanje vozila samo ako zbog zaustavljenog vozila pješak mora silaziti na kolnik ili drugu površinu odnosno da je prolaz između parkiranog vozila i zgrade manji od 100 centimetara – naveli su.
Dakle, ako nepropisno parkirate na nogostupu vjerojatno će vas na vozilu dočekati kazna, ali ako ostavite dovoljno mjesta za prolazak pješaka (više od jednog metra) pauk služba vam nema pravo ukloniti vozilo te moraju dokazati da je vaše vozilo ometalo kretanje pješaka. Preporučamo da ubuduće u obaveznu opremu dodate i jedan metar koji bi vas mogao spasiti od paprene kazne i odlaska po vozilo na Pujanke.
