Dragan Čurak, prokurist, poslao je reagiranje kao zastupnik trgovačkog društva RamseyBay, u vezi članka koji je objavljen na web stranici portala Zadarski.hr 30.09.2022. godine pod naslovom: „Stanari zaustavili RamseyBay na Polačišću. Odvjetnik Marinović: ‘Podnijeli smo dvije ustavne tužbe, ići ćemo do Strasbourga, Haaga i Washingtona!‘“, tvrdeći da su u članku iznesene netočne informacije koje se u nastavku navode.
- Netočna je informacija da je: „Sutkinja Tereza Mitrović u četvrtak prihvatila prijedlog predstavnika stanara zgrade u ulici Petra Svačića (od broja 3 do 11) za odgodom ovrhe odnosno uvođenja vlasnika tvrtke RamseyBay u posjed.“ Zaključkom Općinskog suda u Zadru od 29.09.2022. godine odgođena je provedba ovrhe do donošenje odluke po prijedlogu ovršenika za odgodu. Dakle, Općinski sud u Zadru nije prihvatio prijedlog predstavnika stanara zgrade u ulici Petra Svačića (od broja 3 do 11) za odgodom ovrhe odnosno uvođenja vlasnika tvrtke RamseyBay u posjed, a kako se to netočno navodi u predmetnom članku, već je Sud odgodio provedbu ovrhe do donošenja odluke po prijedlogu ovršenika za odgodu.
Nadalje, netočna je informacija da će Sud „o prijedlogu ovršenika za odgodu odlučiti tek kada bude riješen ovršenikov zahtijev za revizijom postupka“. Okolnost da su ovršenici podnijeli zahtjev za reviziju postupka ne utječe na to kada će Općinski sud u Zadru odlučiti o prijedlogu ovršenika za odgodu, pa je netočno da će Sud o prijedlogu ovršenika za odgodu odlučiti tek kada bude riješen ovršenikov zahtijev za revizijom postupka.
Nadalje, navodi odvjetnika Marinovića izneseni u predmetnom članku koji se citiraju: „da će blokirati privatnu imovinu tvrtke RamseyBay sve dok se ne ispune obveze prema njegovim strankama iz kupoprodajnog ugovora“, nisu osnovani. Naime, trgovačko društvo RamseyBay d.o.o. nema obveze prema strankama odvjetnika Marinovića, a niti između stranaka odvjetnika Marinovića i trgovačkog društva RamseyBay d.o.o. postoji bilo kakav kupoprodajni ugovor. Stoga, ne postoji niti pravni osnov na temelju kojeg bi odvjetnik Marinović, odnosno njegove stranke mogle blokirati privatnu imovinu trgovačkog društva RamseyBay d.o.o.
Također je netočna informacija: „da je trgovačko društvo RamseyBay d.o.o. preuzelo obvezu osiguranja 50 parkirnih mjesta na parceli ispred stambene zgrade stranaka odvjetnika Marinoviću“. Ponavlja se da trgovačko društvo RamseyBay d.o.o. nema obveze prema strankama odvjetnika Marinovića, a niti između stranaka odvjetnika Marinovića i trgovačkog društva RamseyBay d.o.o. postoji bilo kakav ugovor. Slijedom toga, netočne su informacije iz predmetnog članka da bi „Grad Zadar mogao odbiti izdati građevinsku dozvolu investitoru, odnosno da bi mogao tražiti raskidanje kupoprodajnog ugovora.“

Odvjetnik Marinović: ‘Podnijeli smo dvije ustavne tužbe, ići ćemo do Strasbourga, Haaga i Washingtona!‘“, tvrdeći da su u članku iznesene netočne informacije koje se u nastavku navode.
- Netočna je informacija da je: „Sutkinja Tereza Mitrović u četvrtak prihvatila prijedlog predstavnika stanara zgrade u ulici Petra Svačića (od broja 3 do 11) za odgodom ovrhe odnosno uvođenja vlasnika tvrtke RamseyBay u posjed.“ Zaključkom Općinskog suda u Zadru od 29.09.2022. godine odgođena je provedba ovrhe do donošenje odluke po prijedlogu ovršenika za odgodu. Dakle, Općinski sud u Zadru nije prihvatio prijedlog predstavnika stanara zgrade u ulici Petra Svačića (od broja 3 do 11) za odgodom ovrhe odnosno uvođenja vlasnika tvrtke RamseyBay u posjed, a kako se to netočno navodi u predmetnom članku, već je Sud odgodio provedbu ovrhe do donošenja odluke po prijedlogu ovršenika za odgodu.
Nadalje, netočna je informacija da će Sud „o prijedlogu ovršenika za odgodu odlučiti tek kada bude riješen ovršenikov zahtijev za revizijom postupka“. Okolnost da su ovršenici podnijeli zahtjev za reviziju postupka ne utječe na to kada će Općinski sud u Zadru odlučiti o prijedlogu ovršenika za odgodu, pa je netočno da će Sud o prijedlogu ovršenika za odgodu odlučiti tek kada bude riješen ovršenikov zahtijev za revizijom postupka.
Nadalje, navodi odvjetnika Marinovića izneseni u predmetnom članku koji se citiraju: „da će blokirati privatnu imovinu tvrtke RamseyBay sve dok se ne ispune obveze prema njegovim strankama iz kupoprodajnog ugovora“, nisu osnovani. Naime, trgovačko društvo RamseyBay d.o.o. nema obveze prema strankama odvjetnika Marinovića, a niti između stranaka odvjetnika Marinovića i trgovačkog društva RamseyBay d.o.o. postoji bilo kakav kupoprodajni ugovor. Stoga, ne postoji niti pravni osnov na temelju kojeg bi odvjetnik Marinović, odnosno njegove stranke mogle blokirati privatnu imovinu trgovačkog društva RamseyBay d.o.o.
Također je netočna informacija: „da je trgovačko društvo RamseyBay d.o.o. preuzelo obvezu osiguranja 50 parkirnih mjesta na parceli ispred stambene zgrade stranaka odvjetnika Marinoviću“. Ponavlja se da trgovačko društvo RamseyBay d.o.o. nema obveze prema strankama odvjetnika Marinovića, a niti između stranaka odvjetnika Marinovića i trgovačkog društva RamseyBay d.o.o. postoji bilo kakav ugovor. Slijedom toga, netočne su informacije iz predmetnog članka da bi „Grad Zadar mogao odbiti izdati građevinsku dozvolu investitoru, odnosno da bi mogao tražiti raskidanje kupoprodajnog ugovora.“
