Županijsko državno odvjetništvo u Zadru donijelo je rješenje o provođenju istrage protiv državljanke Republike Hrvatske (1972.) i državljanina Republike Hrvatske (1966.) zbog osnovane sumnje na počinjenje kaznenog djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi sa st. 1. Kaznenog zakona, kaznenog djela prijevare iz čl. 247. st. 2. u svezi sa st. 1. KZ-a, kao i protiv prvookrivljenice zbog kaznenog djela prouzročenja stečaja iz čl. 249. st. 3. u svezi sa st. 1. toč. 1. KZ-a.

Postoji osnovana sumnja da su tijekom 2015. godine te od 2017. do 2020. godine u jednom mjestu na otoku Pagu, prvookrivljenica kao član uprave jednog trgovačkog društva, i drugookrivljenik kao osnivač istog društva, postupili s ciljem da za to društvo ostvare nepripadnu materijalnu dobit. Osnovano se sumnja da su zatražili od Lučke uprave odobrenje za mjesto u luci te ukrcaj i iskrcaj putnika za putnički brod u vlasništvu njihova društva, lažno predočivši da će uredno ispunjavati sve obveze vezane uz usluge uporabe obale i brodsku ležarinu za taj brod. S obzirom da im to nije bila namjera, osnovano se sumnja da su u tom razdoblju propustili uplatiti citirane obveze u ukupnom iznosu od 274.809,94 kune. 

Osnovano se sumnja da je prvookrivljenica, u istom svojstvu, zajednički i dogovorno s drugookrivljenikom, u istom svojstvu, zaključila 7. rujna 2020. sa drugookrivljenikom ugovor o kupoprodaji spomenutog putničkog broda za iznos od 187.500,00 kuna na temelju kojeg su prenijeli vlasništvo tog broda na drugo društvo, koje je bilo u vlasništvu njihovog sina, a u tom je društvu drugookrivljenik bio član uprave. Kako kupoprodajna cijena nikad nije bila isplaćena niti je društvo njihovog sina imalo bilo kakvo potraživanje prema njihovom društvu, tako su okrivljenici, osnovano se sumnja, oštetili svoje društvo za navedeni iznos.

Postoji osnovana sumnja da je prvookrivljenica, u istom svojstvu, 7. rujna 2020., kako bi umanjila buduću stečajnu masu društva kojeg je zastupala; svjesna da to društvo ne može podmirivati svoje financijske obveze i da je račun tog društva u blokadi; unatoč tome zaključila prethodno spomenuti ugovor o kupoprodaji plovila za navedeni iznos koji nikad nije isplaćen njenom društvu kao prodavatelju. Trgovački sud u Rijeci je u rujnu 2021. godine otvorio i zaključio stečajni postupak nad njenim društvom budući da imovina tog društva nije bila dostatna niti za podmirenje troškova stečajnog postupka.

Županijsko državno odvjetništvo u Zadru donijelo je rješenje o provođenju istrage protiv državljanke Republike Hrvatske (1972.) i državljanina Republike Hrvatske (1966.) zbog osnovane sumnje na počinjenje kaznenog djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi sa st. 1. Kaznenog zakona, kaznenog djela prijevare iz čl. 247. st. 2. u svezi sa st. 1. KZ-a, kao i protiv prvookrivljenice zbog kaznenog djela prouzročenja stečaja iz čl. 249. st. 3. u svezi sa st. 1. toč. 1. KZ-a.

Postoji osnovana sumnja da su tijekom 2015. godine te od 2017. do 2020. godine u jednom mjestu na otoku Pagu, prvookrivljenica kao član uprave jednog trgovačkog društva, i drugookrivljenik kao osnivač istog društva, postupili s ciljem da za to društvo ostvare nepripadnu materijalnu dobit. Osnovano se sumnja da su zatražili od Lučke uprave odobrenje za mjesto u luci te ukrcaj i iskrcaj putnika za putnički brod u vlasništvu njihova društva, lažno predočivši da će uredno ispunjavati sve obveze vezane uz usluge uporabe obale i brodsku ležarinu za taj brod. S obzirom da im to nije bila namjera, osnovano se sumnja da su u tom razdoblju propustili uplatiti citirane obveze u ukupnom iznosu od 274.809,94 kune. 

Osnovano se sumnja da je prvookrivljenica, u istom svojstvu, zajednički i dogovorno s drugookrivljenikom, u istom svojstvu, zaključila 7. rujna 2020. sa drugookrivljenikom ugovor o kupoprodaji spomenutog putničkog broda za iznos od 187.500,00 kuna na temelju kojeg su prenijeli vlasništvo tog broda na drugo društvo, koje je bilo u vlasništvu njihovog sina, a u tom je društvu drugookrivljenik bio član uprave. Kako kupoprodajna cijena nikad nije bila isplaćena niti je društvo njihovog sina imalo bilo kakvo potraživanje prema njihovom društvu, tako su okrivljenici, osnovano se sumnja, oštetili svoje društvo za navedeni iznos.

Postoji osnovana sumnja da je prvookrivljenica, u istom svojstvu, 7. rujna 2020., kako bi umanjila buduću stečajnu masu društva kojeg je zastupala; svjesna da to društvo ne može podmirivati svoje financijske obveze i da je račun tog društva u blokadi; unatoč tome zaključila prethodno spomenuti ugovor o kupoprodaji plovila za navedeni iznos koji nikad nije isplaćen njenom društvu kao prodavatelju. Trgovački sud u Rijeci je u rujnu 2021. godine otvorio i zaključio stečajni postupak nad njenim društvom budući da imovina tog društva nije bila dostatna niti za podmirenje troškova stečajnog postupka.

Članica uprave društva i osnivač ostali dužni za brodsku ležarinu 274.809 kuna, osumnjičeni i da su muljali s prodajom broda, sve završilo neslavno

Županijsko državno odvjetništvo u Zadru donijelo je rješenje o provođenju istrage protiv državljanke Republike Hrvatske (1972.) i državljanina Republike Hrvatske (1966.) zbog osnovane sumnje na počinjenje kaznenog djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi sa st. 1. Kaznenog zakona, kaznenog djela prijevare iz čl. 247. st. 2. u svezi sa st. 1. KZ-a, kao i protiv prvookrivljenice zbog kaznenog djela prouzročenja stečaja iz čl. 249. st. 3. u svezi sa st. 1. toč. 1. KZ-a.

Postoji osnovana sumnja da su tijekom 2015. godine te od 2017. do 2020. godine u jednom mjestu na otoku Pagu, prvookrivljenica kao član uprave jednog trgovačkog društva, i drugookrivljenik kao osnivač istog društva, postupili s ciljem da za to društvo ostvare nepripadnu materijalnu dobit. Osnovano se sumnja da su zatražili od Lučke uprave odobrenje za mjesto u luci te ukrcaj i iskrcaj putnika za putnički brod u vlasništvu njihova društva, lažno predočivši da će uredno ispunjavati sve obveze vezane uz usluge uporabe obale i brodsku ležarinu za taj brod. S obzirom da im to nije bila namjera, osnovano se sumnja da su u tom razdoblju propustili uplatiti citirane obveze u ukupnom iznosu od 274.809,94 kune. 

Osnovano se sumnja da je prvookrivljenica, u istom svojstvu, zajednički i dogovorno s drugookrivljenikom, u istom svojstvu, zaključila 7. rujna 2020. sa drugookrivljenikom ugovor o kupoprodaji spomenutog putničkog broda za iznos od 187.500,00 kuna na temelju kojeg su prenijeli vlasništvo tog broda na drugo društvo, koje je bilo u vlasništvu njihovog sina, a u tom je društvu drugookrivljenik bio član uprave. Kako kupoprodajna cijena nikad nije bila isplaćena niti je društvo njihovog sina imalo bilo kakvo potraživanje prema njihovom društvu, tako su okrivljenici, osnovano se sumnja, oštetili svoje društvo za navedeni iznos.

Postoji osnovana sumnja da je prvookrivljenica, u istom svojstvu, 7. rujna 2020., kako bi umanjila buduću stečajnu masu društva kojeg je zastupala; svjesna da to društvo ne može podmirivati svoje financijske obveze i da je račun tog društva u blokadi; unatoč tome zaključila prethodno spomenuti ugovor o kupoprodaji plovila za navedeni iznos koji nikad nije isplaćen njenom društvu kao prodavatelju. Trgovački sud u Rijeci je u rujnu 2021. godine otvorio i zaključio stečajni postupak nad njenim društvom budući da imovina tog društva nije bila dostatna niti za podmirenje troškova stečajnog postupka.
