Vrhovni sud RH povisio je zatvorsku kaznu Marinu Kameničkom sa četiri i pol na šest godina zatvora. Kamenički je osuđen za izazivanje prometne nesreće u cestovnom prometu kojom je prouzročio smrt dvije osobe, piše Jutarnji list.
Time je presuda postala pravomoćna, a Kameničkom je, s obzirom da je dobio više od pet godina zatvora, odmah određen istražni zatvor.
"Vrhovni je sud donio presudu kojom je prihvatio žalbu državnog odvjetnika i preinačio u odluci o kazni presudu Županijskog suda u Zagrebu. Time je postala pravomoćna presuda kojom je optuženik proglašen krivim za izazivanje prometne nesreće u cestovnom prometu.
Optuženik je osuđen jer je prouzrokovao prometnu nesreću upravljajući osobnim vozilom brzinom 195 km/h na mjestu gdje je brzina kretanja vozila ograničena na 50 km/h. Zbog prevelike brzine kretanja je izgubio nadzor nad vozilom. To je dovelo do destabilizacije i rotacije vozila te prelaska vozila na kolnik namijenjen kretanju vozila iz suprotnog smjera te sudara s drugim vozilom.
Uslijed udara je došlo do otvaranja suvozačevih vrata na vozilu optuženika. Sa suvozačevog je mjesta iz vozila izletjela ženska osoba i tijelom udarila u treće vozilo. Višestruko je ozlijeđena i na mjestu događaja preminula. Vozač vozila u koje je udarilo vozilo optuženika je teško tjelesno ozlijeđen, a njegova suvozačica je od zadobivenih višestrukih ozljeda na mjestu događaja preminula. Vozilo optuženika se potom nastavilo nekontrolirano kretati te udarilo u još jedno vozilo i zapalilo.
Prvostupanjskom je presudom optuženik osuđen na kaznu zatvora 4 (četiri) godine i 6 (šest) mjeseci. Izrečena mu je sigurnosna mjera zabrane upravljanja motornim vozilom svih kategorija u trajanju koje je 5 (pet) godina dulje od izrečene kazne zatvora.
Vrhovni je sud preinačio u odluci o kazni prvostupanjsku presudu i optuženika osudio na kaznu zatvora 6 (šest) godina. Uslijed preinačenja prvostupanjske presude izrečena kazna zatvora je teža od pet godina pa mu je zato određen istražni zatvor.
Vrhovni sud smatra da je prvostupanjski sud odmjerio kaznu u prekratkom trajanju jer sve utvrđene okolnosti nisu primjereno vrednovane prilikom odmjeravanja visine kazne zatvora. Brzina kojom je vozio optuženik gotovo četverostruko premašuje brzinu propisanu za naseljena mjesta (50 km/h).
Osim toga, riječ je o važnoj i frekventnoj gradskoj prometnici po kojoj je u svako doba gust promet. To sve upućuje na značajan stupanj kriminalne volje na strani optuženika. Takvim bezobzirnim načinom vožnje prouzročio je smrt dvije osobe te osobito tešku tjelesnu ozljedu jedne osobe koja se od posljedica ozljeđivanja i dalje liječi. Sve te okolnosti u svojoj ukupnosti nadilaze okolnosti koje su inače potrebne za postojanje ovoga kaznenoga djela osobito u odnosu na težinu posljedica kaznenih djela iz oblasti prometa.
Pukim slučajem posljedice nisu bile još i teže. Optuženiku je pravilno kao olakotna okolnost cijenjena njegova mlada dob (22 godine), ali je propušteno dati značaj činjenici da je žrtva koja je kao suvozačica u vozilu optuženika poginula bila također mlada osoba, približne dobi kao i optuženik.
Postrožena je kazna primjerena ličnosti optuženika i počinjenom djelu. Takva kazna je pogodna za ostvarenje svrhe kažnjavanja i izražavanja društvene osude zbog počinjenog kaznenog djela, a pri tom je uzeta u obzir iznimna pogibeljnost takvog neobuzdanog ponašanja u prometu i s tim u vezi težine posljedica koje mogu nastupiti. Kazna treba utjecati na optuženika, ali i na sve druge da ne čine kaznena djela. Ujedno će utjecati na svijest građana da je činjenje kaznenih djela pogibeljno, a kažnjavanje počinitelja pravedno."

Vrhovni sud RH povisio je zatvorsku kaznu Marinu Kameničkom sa četiri i pol na šest godina zatvora. Kamenički je osuđen za izazivanje prometne nesreće u cestovnom prometu kojom je prouzročio smrt dvije osobe, piše Jutarnji list.
Time je presuda postala pravomoćna, a Kameničkom je, s obzirom da je dobio više od pet godina zatvora, odmah određen istražni zatvor.
"Vrhovni je sud donio presudu kojom je prihvatio žalbu državnog odvjetnika i preinačio u odluci o kazni presudu Županijskog suda u Zagrebu. Time je postala pravomoćna presuda kojom je optuženik proglašen krivim za izazivanje prometne nesreće u cestovnom prometu.
Optuženik je osuđen jer je prouzrokovao prometnu nesreću upravljajući osobnim vozilom brzinom 195 km/h na mjestu gdje je brzina kretanja vozila ograničena na 50 km/h. Zbog prevelike brzine kretanja je izgubio nadzor nad vozilom. To je dovelo do destabilizacije i rotacije vozila te prelaska vozila na kolnik namijenjen kretanju vozila iz suprotnog smjera te sudara s drugim vozilom.
Uslijed udara je došlo do otvaranja suvozačevih vrata na vozilu optuženika. Sa suvozačevog je mjesta iz vozila izletjela ženska osoba i tijelom udarila u treće vozilo. Višestruko je ozlijeđena i na mjestu događaja preminula. Vozač vozila u koje je udarilo vozilo optuženika je teško tjelesno ozlijeđen, a njegova suvozačica je od zadobivenih višestrukih ozljeda na mjestu događaja preminula. Vozilo optuženika se potom nastavilo nekontrolirano kretati te udarilo u još jedno vozilo i zapalilo.
Prvostupanjskom je presudom optuženik osuđen na kaznu zatvora 4 (četiri) godine i 6 (šest) mjeseci. Izrečena mu je sigurnosna mjera zabrane upravljanja motornim vozilom svih kategorija u trajanju koje je 5 (pet) godina dulje od izrečene kazne zatvora.
Vrhovni je sud preinačio u odluci o kazni prvostupanjsku presudu i optuženika osudio na kaznu zatvora 6 (šest) godina. Uslijed preinačenja prvostupanjske presude izrečena kazna zatvora je teža od pet godina pa mu je zato određen istražni zatvor.
Vrhovni sud smatra da je prvostupanjski sud odmjerio kaznu u prekratkom trajanju jer sve utvrđene okolnosti nisu primjereno vrednovane prilikom odmjeravanja visine kazne zatvora. Brzina kojom je vozio optuženik gotovo četverostruko premašuje brzinu propisanu za naseljena mjesta (50 km/h).
Osim toga, riječ je o važnoj i frekventnoj gradskoj prometnici po kojoj je u svako doba gust promet. To sve upućuje na značajan stupanj kriminalne volje na strani optuženika. Takvim bezobzirnim načinom vožnje prouzročio je smrt dvije osobe te osobito tešku tjelesnu ozljedu jedne osobe koja se od posljedica ozljeđivanja i dalje liječi. Sve te okolnosti u svojoj ukupnosti nadilaze okolnosti koje su inače potrebne za postojanje ovoga kaznenoga djela osobito u odnosu na težinu posljedica kaznenih djela iz oblasti prometa.
Pukim slučajem posljedice nisu bile još i teže. Optuženiku je pravilno kao olakotna okolnost cijenjena njegova mlada dob (22 godine), ali je propušteno dati značaj činjenici da je žrtva koja je kao suvozačica u vozilu optuženika poginula bila također mlada osoba, približne dobi kao i optuženik.
Postrožena je kazna primjerena ličnosti optuženika i počinjenom djelu. Takva kazna je pogodna za ostvarenje svrhe kažnjavanja i izražavanja društvene osude zbog počinjenog kaznenog djela, a pri tom je uzeta u obzir iznimna pogibeljnost takvog neobuzdanog ponašanja u prometu i s tim u vezi težine posljedica koje mogu nastupiti. Kazna treba utjecati na optuženika, ali i na sve druge da ne čine kaznena djela. Ujedno će utjecati na svijest građana da je činjenje kaznenih djela pogibeljno, a kažnjavanje počinitelja pravedno."
