Potrošač se konverzijom nije odrekao svojih budućih prava niti je zakonom to dopušteno, istaknuto je u Facebook objavi Udruge Franak koja očekuje konačne odluke Vrhovnog suda Republike Hrvatske o pravu 55.000 potrošača koji su konvertirali CHF kredite na obeštećenje.

- Očekujemo da Vrhovni sud u skladu s hrvatskim pravom te odlukama Suda EU C-118/17 i C-260/18, kojima je nedvojbeno utvrđeno pravo potrošača na punu restituciju nakon konverzije, odluči jednako tako da hrvatski potrošači imaju pravo na vraćanje svega što su banke stekle primjenom nepoštene kamate i nepoštene valute, kao i pravo na obračun pripadajućih zateznih kamata. Paralelno Vrhovni sud RH odlučuje i o ništetnosti cijelih ugovora s ništetnim kamatama i ništetnom valutom, pa i u tome smislu očekujemo odluku u korist potrošača, opet u skladu s istim presudama Suda EU – kazao nam je tim povodom Goran Aleksić, koordinator ekonomsko-pravnog tima Udruge Franak.

U FB objavi u Udruzi Franak podsjetili su kakvo su mišljenje o konvertiranim predmetima u hrvatskom predmetu C-567/20, u kojem je Sud EU proglasio svoju nenadležnost, imali Europska komisija i nezavisna odvjetnica Juliane Kokott.

4. PRIJEDLOG ODGOVORA NA PRETHODNA PITANJA

77. Komisija predlaže Sudu da odgovori na pitanja iz zahtjeva za prethodnu odluku kako slijedi:

1. Članak 6. stavak 1. i članak 7. stavak 1. Direktive 93/13 treba tumačiti na način da im se protivi nacionalni propis poput onog u glavnom postupku, na temelju kojeg su vjerovnici obvezani ponuditi sklapanje dodataka ugovora o kreditu kojima se nepoštene ugovorne odredbe o CHF valutnoj klauzuli i promjenjivoj kamatnoj stopi retroaktivno zamjenjuju zakonski definiranim odredbama koje odgovaraju sadržaju ugovora o kreditu s EUR valutnom klauzulom, ukoliko bi se taj zakon tumačio na način da izravno ili putem dodatka ugovora onemogućava potrošača da sudski osporava odredbe originalnog ugovora ili na zakonu uspostavljenog dodatka ugovora s ciljem ostvarivanja svojeg prava na puni povrat koristi stečene na njegovu štetu na temelju nepoštenih ugovornih odredaba, osim ako se potrošač tog prava slobodno, izričito i nedvosmisleno odrekao nakon što su mu pružene sve relevantne informacije dostupne u vrijeme sklapanja dodatka, a što treba ocijeniti nacionalni sud.

2. Nacionalni sud, kad odlučuje u sporu između potrošača i banke o posljedicama nepoštenosti ugovornih odredaba poput onog u glavnom postupku dužan je, kad primjenjuje odredbe unutarnjeg prava, uzeti u obzir sveukupnost pravila nacionalnog prava i tumačiti ih u najvećoj mogućoj mjeri u svjetlu teksta kao i cilja direktive mjerodavne u konkretnom području radi postizanja rješenja usklađenog s ciljem direktive. Ako ne može provesti tumačenje nacionalnog propisa sukladno zahtjevima Direktive 93/13, dužan je osigurati puni učinak članku 6. stavku 1. Direktive 93/13 na način da, ako je potrebno, ne primijeni odredbu nacionalnog prava ili nacionalnu sudsku praksu koji sprečavaju primjenu te odredbe.

I. Uvod

1. Članak 6. stavak 1. Direktive 93/13 obvezuje države članice da osiguraju da nepoštene odredbe u potrošačkim ugovorima nisu obvezujuće za potrošače. Pri tome bi, ako je moguće, ugovor trebao nastaviti važiti bez tih nepoštenih odredaba. Ako se iznimno putem zakonodavne intervencije nepoštena odredba u jednom takvom ugovoru zamijeni novom odredbom, prema ustaljenoj sudskoj praksi, mora se osigurati da se time ponovno uspostavi pravna i činjenična situacija potrošača u kojoj bi se nalazio da navedene odredbe nije bilo. Potrošač mora osobito moći tražiti povrat svih koristi koje je prodavatelj robe ili pružatelj usluge na temelju nepoštene odredbe neopravdano stekao na njegovu štetu (tzv. restitucijski učinak), naveli su u Udruzi Franak.

Potrošač se konverzijom nije odrekao svojih budućih prava niti je zakonom to dopušteno, istaknuto je u Facebook objavi Udruge Franak koja očekuje konačne odluke Vrhovnog suda Republike Hrvatske o pravu 55.000 potrošača koji su konvertirali CHF kredite na obeštećenje.

- Očekujemo da Vrhovni sud u skladu s hrvatskim pravom te odlukama Suda EU C-118/17 i C-260/18, kojima je nedvojbeno utvrđeno pravo potrošača na punu restituciju nakon konverzije, odluči jednako tako da hrvatski potrošači imaju pravo na vraćanje svega što su banke stekle primjenom nepoštene kamate i nepoštene valute, kao i pravo na obračun pripadajućih zateznih kamata. Paralelno Vrhovni sud RH odlučuje i o ništetnosti cijelih ugovora s ništetnim kamatama i ništetnom valutom, pa i u tome smislu očekujemo odluku u korist potrošača, opet u skladu s istim presudama Suda EU – kazao nam je tim povodom Goran Aleksić, koordinator ekonomsko-pravnog tima Udruge Franak.

U FB objavi u Udruzi Franak podsjetili su kakvo su mišljenje o konvertiranim predmetima u hrvatskom predmetu C-567/20, u kojem je Sud EU proglasio svoju nenadležnost, imali Europska komisija i nezavisna odvjetnica Juliane Kokott.

4. PRIJEDLOG ODGOVORA NA PRETHODNA PITANJA

77. Komisija predlaže Sudu da odgovori na pitanja iz zahtjeva za prethodnu odluku kako slijedi:

1. Članak 6. stavak 1. i članak 7. stavak 1. Direktive 93/13 treba tumačiti na način da im se protivi nacionalni propis poput onog u glavnom postupku, na temelju kojeg su vjerovnici obvezani ponuditi sklapanje dodataka ugovora o kreditu kojima se nepoštene ugovorne odredbe o CHF valutnoj klauzuli i promjenjivoj kamatnoj stopi retroaktivno zamjenjuju zakonski definiranim odredbama koje odgovaraju sadržaju ugovora o kreditu s EUR valutnom klauzulom, ukoliko bi se taj zakon tumačio na način da izravno ili putem dodatka ugovora onemogućava potrošača da sudski osporava odredbe originalnog ugovora ili na zakonu uspostavljenog dodatka ugovora s ciljem ostvarivanja svojeg prava na puni povrat koristi stečene na njegovu štetu na temelju nepoštenih ugovornih odredaba, osim ako se potrošač tog prava slobodno, izričito i nedvosmisleno odrekao nakon što su mu pružene sve relevantne informacije dostupne u vrijeme sklapanja dodatka, a što treba ocijeniti nacionalni sud.

2. Nacionalni sud, kad odlučuje u sporu između potrošača i banke o posljedicama nepoštenosti ugovornih odredaba poput onog u glavnom postupku dužan je, kad primjenjuje odredbe unutarnjeg prava, uzeti u obzir sveukupnost pravila nacionalnog prava i tumačiti ih u najvećoj mogućoj mjeri u svjetlu teksta kao i cilja direktive mjerodavne u konkretnom području radi postizanja rješenja usklađenog s ciljem direktive. Ako ne može provesti tumačenje nacionalnog propisa sukladno zahtjevima Direktive 93/13, dužan je osigurati puni učinak članku 6. stavku 1. Direktive 93/13 na način da, ako je potrebno, ne primijeni odredbu nacionalnog prava ili nacionalnu sudsku praksu koji sprečavaju primjenu te odredbe.

I. Uvod

1. Članak 6. stavak 1. Direktive 93/13 obvezuje države članice da osiguraju da nepoštene odredbe u potrošačkim ugovorima nisu obvezujuće za potrošače. Pri tome bi, ako je moguće, ugovor trebao nastaviti važiti bez tih nepoštenih odredaba. Ako se iznimno putem zakonodavne intervencije nepoštena odredba u jednom takvom ugovoru zamijeni novom odredbom, prema ustaljenoj sudskoj praksi, mora se osigurati da se time ponovno uspostavi pravna i činjenična situacija potrošača u kojoj bi se nalazio da navedene odredbe nije bilo. Potrošač mora osobito moći tražiti povrat svih koristi koje je prodavatelj robe ili pružatelj usluge na temelju nepoštene odredbe neopravdano stekao na njegovu štetu (tzv. restitucijski učinak), naveli su u Udruzi Franak.
