Miho Vuković, suvlasnik i prokurist tvrtke Riva Liburna, u čijem je vlasništvu "Ledana", reagira na članak TKO JE U PRAVU? Suvlasnik Ledane: Tko iznajmi poslovni prostor za ugostiteljski objekt, ima pravo na 50 metara javne površine. Pročelnik Korona: Ne, nije tako! Prenosimo ga u cijelosti:

"Sukladno čl. 56. Zakona o medijima, a u cilju istinitog/cjelovitog informiranja javnosti želim iznijeti odgovor na članak pod naslovom "Tko je u pravu" koji je 14.04.2023. godine objavljen na portalu Zadarski.hr, te sukladno Zakonu, objavu odgovora.

Najprije želim ispraviti navod koji je netočno prenesen nakon moje izjave od 11.04.2023. godine. Jer nisam izjavio da imamo pravo na zakup javne površine od 50 m2 nego da imamo pravo na zakup javne površine ako se ista nalazi ispred ugostiteljskog objekta ili u njegovoj blizini npr. na udaljenosti 50 m od ugostiteljskog objekta.

Što se tiče izjave pročelnika gosp. Korone u kojoj navodi proceduru za ishođenje i korištenja javnog prostora, smatram potrebnim naglasiti da je Riva Liburna d.o.o. kod zakupa javne površine postupala u skladu s tom procedurom te navodim sljedeće:

Ugostiteljski objekt "Ledana" posjeduje minimalne uvjete za poslovanje kao ugostiteljski objekt.

Riva Liburna d.o.o. je dostavila zahtjev Nasadima d.o.o. s pripadajućom skicom uređenja javnog prostora ispred ugostiteljskog objekta "Ledana" prije nego smo započeli ikakve radove na javnoj površini.

Nakon odobrenja po priloženoj skici Riva Liburna je ulažući vlastita sredstva u javni prostor uredila javnu površinu u kvadraturi sukladno skici, a koja je veća nego što smo je koristili, sve u cilju uređenja čitave površine tog dijela Perivoja, a ne samo površine ispred ugostiteljskog objekta "Ledane".

Radove smo izveli prema uputama i pravilima struke o čemu govori, između ostalog, i podatak da smo morali pronaći odgovarajući kamen za uređenje šetnice, koji vrstom i bojom odgovara kamenu ogradnih suhozidova u perivoju Kraljice Jelene.

Korištenjem javne površine ispred ugostiteljskog objekta "Ledana" ne narušava se nikakav pješački koridor o čemu svjedoče brojni turisti koji slobodno šetaju Perivojem, kao i rekreativci koji trče i hodaju Perivojem, a niti se narušavaju prometni koridori jer u Perivoju ne postoje prometnice.

Riva Liburna d.o.o. zakupljuje javnu površinu već 11 god bez ikakvog prigovora od strane zakupodavca iii Grada.

Ovo sve što sam naveo bi trebalo biti poznato gosp. Koroni koji je ujedno i predsjednik NO Nasada d.o.o.

26. 11. 2022. prije isteka postojećeg Ugovora o zakupu uputili smo pismeni zahtjev zakupodavcu za produženje Ugovora o zakupu javne površine u 2023. god, a 14. 12. 2022. uputili smo požurnicu zakupodavcu po istom zahtjevu, međutim, kako se zakupodavac nije oglasio na naš zahtjev nikakvim odgovorom odlučili smo tužiti Nasade d.o.o što smo i učinili tužbom nadležnom sudu. Iako je sudski postupak u tijeku, nadamo se sporazumnom rješavanju nastale situacije.

Korištenje i zakup javne površine je definirano odlukama Gradskog vijeća Grada Zadra o zakupu javnih površina te Planom korištenja javnih površina prema kojima već 11 godina svake godine obnavljamo ugovore o zakupu javne površine sa zakupodavcem te ne vidimo nijedan razlog, sukladno gore navedenom, da nam se i ove godine ne odobri zakup javne površine (legitimno očekivanje u gospodarskom poslovanju)."

Miho Vuković, suvlasnik i prokurist tvrtke Riva Liburna, u čijem je vlasništvu "Ledana", reagira na članak TKO JE U PRAVU? Suvlasnik Ledane: Tko iznajmi poslovni prostor za ugostiteljski objekt, ima pravo na 50 metara javne površine. Pročelnik Korona: Ne, nije tako! Prenosimo ga u cijelosti:

"Sukladno čl. 56. Zakona o medijima, a u cilju istinitog/cjelovitog informiranja javnosti želim iznijeti odgovor na članak pod naslovom "Tko je u pravu" koji je 14.04.2023. godine objavljen na portalu Zadarski.hr, te sukladno Zakonu, objavu odgovora.

Najprije želim ispraviti navod koji je netočno prenesen nakon moje izjave od 11.04.2023. godine. Jer nisam izjavio da imamo pravo na zakup javne površine od 50 m2 nego da imamo pravo na zakup javne površine ako se ista nalazi ispred ugostiteljskog objekta ili u njegovoj blizini npr. na udaljenosti 50 m od ugostiteljskog objekta.

Što se tiče izjave pročelnika gosp. Korone u kojoj navodi proceduru za ishođenje i korištenja javnog prostora, smatram potrebnim naglasiti da je Riva Liburna d.o.o. kod zakupa javne površine postupala u skladu s tom procedurom te navodim sljedeće:

Ne postoje dugovi od strane Riva Liburne d.o.o. ni prema Gradu ni prema zakupodavcu Nasadi d.o.o.

Ugostiteljski objekt "Ledana" posjeduje minimalne uvjete za poslovanje kao ugostiteljski objekt.

Riva Liburna d.o.o. je dostavila zahtjev Nasadima d.o.o. s pripadajućom skicom uređenja javnog prostora ispred ugostiteljskog objekta "Ledana" prije nego smo započeli ikakve radove na javnoj površini.

Nakon odobrenja po priloženoj skici Riva Liburna je ulažući vlastita sredstva u javni prostor uredila javnu površinu u kvadraturi sukladno skici, a koja je veća nego što smo je koristili, sve u cilju uređenja čitave površine tog dijela Perivoja, a ne samo površine ispred ugostiteljskog objekta "Ledane".

Radove smo izveli prema uputama i pravilima struke o čemu govori, između ostalog, i podatak da smo morali pronaći odgovarajući kamen za uređenje šetnice, koji vrstom i bojom odgovara kamenu ogradnih suhozidova u perivoju Kraljice Jelene.

Korištenjem javne površine ispred ugostiteljskog objekta "Ledana" ne narušava se nikakav pješački koridor o čemu svjedoče brojni turisti koji slobodno šetaju Perivojem, kao i rekreativci koji trče i hodaju Perivojem, a niti se narušavaju prometni koridori jer u Perivoju ne postoje prometnice.

Riva Liburna d.o.o. zakupljuje javnu površinu već 11 god bez ikakvog prigovora od strane zakupodavca iii Grada.

Ovo sve što sam naveo bi trebalo biti poznato gosp. Koroni koji je ujedno i predsjednik NO Nasada d.o.o.

26. 11. 2022. prije isteka postojećeg Ugovora o zakupu uputili smo pismeni zahtjev zakupodavcu za produženje Ugovora o zakupu javne površine u 2023. god, a 14. 12. 2022. uputili smo požurnicu zakupodavcu po istom zahtjevu, međutim, kako se zakupodavac nije oglasio na naš zahtjev nikakvim odgovorom odlučili smo tužiti Nasade d.o.o što smo i učinili tužbom nadležnom sudu. Iako je sudski postupak u tijeku, nadamo se sporazumnom rješavanju nastale situacije.

Korištenje i zakup javne površine je definirano odlukama Gradskog vijeća Grada Zadra o zakupu javnih površina te Planom korištenja javnih površina prema kojima već 11 godina svake godine obnavljamo ugovore o zakupu javne površine sa zakupodavcem te ne vidimo nijedan razlog, sukladno gore navedenom, da nam se i ove godine ne odobri zakup javne površine (legitimno očekivanje u gospodarskom poslovanju)."

Miho Vuković: Pročelnik Korona bi trebao sve znati, ne vidimo nijedan razlog da se Ledani i ove godine ne odobri zakup javne površine!

Miho Vuković, suvlasnik i prokurist tvrtke Riva Liburna, u čijem je vlasništvu "Ledana", reagira na članak TKO JE U PRAVU? Suvlasnik Ledane: Tko iznajmi poslovni prostor za ugostiteljski objekt, ima pravo na 50 metara javne površine. Pročelnik Korona: Ne, nije tako! Prenosimo ga u cijelosti:

"Sukladno čl. 56. Zakona o medijima, a u cilju istinitog/cjelovitog informiranja javnosti želim iznijeti odgovor na članak pod naslovom "Tko je u pravu" koji je 14.04.2023. godine objavljen na portalu Zadarski.hr, te sukladno Zakonu, objavu odgovora.

Najprije želim ispraviti navod koji je netočno prenesen nakon moje izjave od 11.04.2023. godine. Jer nisam izjavio da imamo pravo na zakup javne površine od 50 m2 nego da imamo pravo na zakup javne površine ako se ista nalazi ispred ugostiteljskog objekta ili u njegovoj blizini npr. na udaljenosti 50 m od ugostiteljskog objekta.

Što se tiče izjave pročelnika gosp. Korone u kojoj navodi proceduru za ishođenje i korištenja javnog prostora, smatram potrebnim naglasiti da je Riva Liburna d.o.o. kod zakupa javne površine postupala u skladu s tom procedurom te navodim sljedeće:

Ne postoje dugovi od strane Riva Liburne d.o.o. ni prema Gradu ni prema zakupodavcu Nasadi d.o.o.

Ugostiteljski objekt "Ledana" posjeduje minimalne uvjete za poslovanje kao ugostiteljski objekt.
